Breach of Contract Remedies

Consequential or Incidental Damages – these are reasonably foreseeable damages which result from a broken contract.

Liquidated Damages – these are terms in your contract which motivate each party to honor the contract.

Punitive Damages – this is essentially a monetary punishment for the party breaking the agreement, and is rare because other remedies are usually easier to obtain.

Specific Performance – the Court orders the contract breaker to perform and honor the contract.  Specific performance is unusual and mostly used to remedy real estate transactions.

Other Remedies may include Recission where both parties are excused from performing their part of the contract and Reformation, where the contract is virtually amended.
